HARTINGTON — District Judge Alfred Raun Monday gave Cedar County Supt. of Schools Velna Weir and State Supt. F.B. Decker and School District 60 of Cedar County 10 days in which to file briefs in an injunction suit brought by the District against the two officials.

The school district filed the injunction suit to prevent the officials from dissolving the school district. The lawsuit alleges that the defendants are attempting to dissolve 60 and attach the territory to District 21.

It is alleged that the defendants have no grounds to commit such an act and that if such an order were entered, residents of District 60 would suffer much loss in property and taxation.

The County Supt. claims that District 60 failed to hold school the six years prior to the 1954-55 school year. Under state school law, any district that for a period of one school term fails to maintain a school within a district for at least 160 days shall be dissolved.

The District was notified in 1954 by Supt. Weir to dissolve. However, no action was taken and the District held school last year for the first time in six years.
